memeSRC Terms of Service

Agreement

These terms are an agreement between you and Vibe House LLC ("we" or "us"), which runs memeSRC. They cover the memeSRC website and the memeSRC apps for iPhone and Android. By using memeSRC, you agree to these terms. Our Privacy Policy explains how we handle personal information. If you don't agree to these terms, please don't use memeSRC.

What memeSRC provides

memeSRC provides a full-featured meme editor, photo editing tools, and tools to upload, save, find, and share editable templates and other content. You can share a template link with friends or publish it for others to discover and edit. Users submit the templates, images, and catalog material available through these tools. Some features use third-party integrations, as explained below.

Who can use memeSRC

You must be at least 13 years old to use memeSRC. If you are under the age of majority where you live, you need a parent or guardian's permission. You're responsible for your account, for keeping your password safe, and for activity that happens under your account.

Acceptable use

We have zero tolerance for objectionable content and abusive users. You may not use memeSRC to create, upload, share, or generate:

• Sexual content involving minors, in any form. We report it to the authorities.
• Pornography, sexually explicit content, or nudity.
• Harassment, bullying, threats, or content that attacks people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age.
• Content that promotes violence, terrorism, self-harm, or dangerous activities.
• Other people's private information, or images of real people made to deceive, demean, or sexualize them.
• Spam, scams, malware, or anything illegal.
• Content that infringes someone else's rights.

You also may not interfere with memeSRC, access other people's accounts, get around usage limits or safety filters, or copy the service or its catalog with automated tools. We can remove content and suspend or close accounts that break these rules, without notice.

Your content and sharing choices

You keep any rights you already have in the content you make or upload. Using memeSRC does not give you ownership of someone else's images, footage, or other material.

You give us permission to host, copy, process, and display your content, including through our service providers, as needed to run memeSRC and carry out your sharing choices. This permission is non-exclusive, worldwide, and royalty-free. When you share a template, you also let people who can access it view, copy, and edit it in memeSRC. You're responsible for having the rights or other legal permission needed for what you upload and share.

Saving a Library item or project does not publish it. Publishing a template makes it available for public discovery; sending an unlisted template link lets anyone with that link open and pass it on. Recipients can save their own copies, which removing your original will not recall. Catalog submissions are intended for public use, and their media may become accessible once approved processing starts, before they appear in search. Our Privacy Policy explains these differences.

Reporting and moderation

Use Report where available on a frame, shared template, or Magic result, or email contact@vibehouse.net. We review reports and aim to act on objectionable content within 24 hours, including removing it and the accounts that posted it. App versions with creator-hiding controls also let you hide a creator's shared templates. Removed content may not be restored.

Rights in content and tools

The memeSRC software and branding are separate from the content users submit. Using our tools does not transfer ownership of that software or branding, or of someone else's content. Third-party software and services remain subject to their respective rights and terms.

User-submitted templates and catalog material may contain images, frames, or subtitles from works owned by others. memeSRC is not affiliated with or endorsed by those owners. Use catalog material for personal, non-commercial meme making. You are responsible for having permission or another legal basis for your use, including whether it qualifies as fair use. A meme, parody, or non-commercial use is not automatically fair use. Access to the tools, including a Pro subscription, does not license the underlying content.

If you believe something on memeSRC infringes your copyright, follow our copyright policy. We close the accounts of repeat infringers in appropriate circumstances.

AI features

Magic Editor uses third-party AI providers, including Google and OpenAI, to edit images. When you use it, the images and instructions for your edit are sent to those providers. AI results can be inaccurate, unexpected, or similar to results made for other people, and we don't guarantee any result. The acceptable use rules above apply to your prompts and results. We may block requests or results that our safety checks flag. Don't present AI-edited images of real people or events as genuine in a way that could mislead others.

Subscriptions and purchases

memeSRC Pro is an auto-renewing subscription that includes Magic credits each billing period. Website subscriptions are billed by Stripe. Where offered, in-app subscriptions are billed by Apple on iPhone or Google on Android. Your subscription renews automatically until you cancel. The price, billing interval, and included credits are shown before you subscribe. Cancel through the service that bills you before its renewal deadline to avoid the next charge.

• App Store: open Settings on your iPhone, tap your name, then Subscriptions. Cancel at least 24 hours before renewal.
• Google Play: open the Play Store, tap your profile, then Payments & subscriptions, then Subscriptions.
• memesrc.com: open Settings, then Billing, and cancel your plan.

Apple and Google handle refunds for purchases made through them under their own policies. For memesrc.com purchases, contact us. Except where the law requires otherwise, payments are non-refundable. Magic credits have no cash value and can't be transferred.

Subscription credits reset each credit cycle and do not roll over. Credits purchased separately remain available across those resets. Cancelling renewal normally leaves your subscription active until the end of the paid period. Deleting your account removes remaining credits and cancels a memesrc.com subscription immediately, but does not cancel one billed by Apple or Google; cancel those in your store account.

Ending your use of memeSRC

You can stop using memeSRC at any time and delete your account. We may suspend or close your account if you break these terms or if we need to for legal or security reasons.

Other services

memeSRC relies on services such as Apple, Google, Stripe, and our AI providers, which have their own terms. We aren't responsible for their services.

Apps from the App Store

If you use the memeSRC iPhone app, these terms are between you and Vibe House LLC only, not Apple. We, not Apple, are responsible for the app, its support, and any claims about it, including product liability, legal compliance, and intellectual property claims. Apple has no obligation to provide maintenance or support. If the app fails to meet an applicable warranty, you may notify Apple for a refund of its purchase price, if any; Apple has no other warranty obligation. You confirm you are not in a country subject to a U.S. embargo and are not on a U.S. list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers

memeSRC is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that memeSRC will be uninterrupted, error-free, or that saved work will never be lost.

Limitation of liability

To the fullest extent the law allows, Vibe House LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for any claim about memeSRC is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.

You agree to cover our reasonable losses and costs from claims that arise from your content or your violation of these terms.

Governing law

These terms are governed by United States law and the laws of South Carolina, where Vibe House LLC is organized, without regard to conflict-of-law rules. These terms do not limit consumer rights that cannot be waived under the law where you live.

Changes to these terms

We may update these terms as memeSRC changes. We'll change the date above and, for significant changes, let you know in the app or by email. If you keep using memeSRC after an update, you accept the new terms.
